2009 Honda CBF - Engine Failure - Sticky piston??

Hi,

My first post to HOC and im afraid its to ask advice which id be much grateful for..

I bought a Honda CBF 125cc last week from a main dealer as my first bike, done 160miles in 8 days and the engine has developed what i was told is "sticky pistons" either due to 'low oil' or the bike been "thrashed". None of these things is the reason as its new and i have been the only one riding it! the dealer says i may have to wait up to a month to get parts as its a new bike type and presumably they never though this problem would happen so early (or at all) so there are no engine replacement parts. it is obviously a big job to do whatever has happened in the engine.

I have been offered a courtesy bike if i get comprehensive insurance but i dont want to spend any more money and they wont pay the extra, does anyone know what my right is here as i idealy want a replacement cbf as im not happy to take the failed bike back and it seems a long time to have to go without a bike for a fault that is exceptional for this mileage.

Can i say i dont want the bike back but only a replacement or my money back as the dealer is not playing ball with me on this. He also offered their Honda cbf training school bike (thus 2nd owner) with 4 times the mileage and in a different colour as a straight swap.

As you haven't said so, presumably the bike wasn't new? 160 mies in 8 days is not very much at all, is it? (Even if you did it all on one day, it doesn't really matter anyway.)
The dealer can hardly accuse you of running low on oil, as it should have been at the correct level when supplied to you. If it ran low on oil in 160 miles, it would suggest something was wrong with it, so that could be in your favour. If you can reasonably prove you haven't 'thrashed' it, it should be up to them to sort it out for you.
I don't think you are automatically entitled to a replacement CBF, but you have to give them a chance to fix it (at no cost to you), and I don't think in law you are entitled to a courtesy bike while they fix it, either. Suggest you seek advice from a Citizen's Advice Bureau to find out where you stand.
Don't take up their offer of that replacement. They want to get shot of it.
